1. About us and these terms
open for offer is a trading name of OMPT Group Limited, a company registered in England and Wales (company number 13206639) whose registered office is at 22 St Peters Street, Stamford, England, PE9 2PF (“we”, “us”, “our”).
By accessing or using openforoffer.com (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms constitute a legally binding agreement between you and OMPT Group Limited.
These terms are governed by the laws of England and Wales. If you are a consumer, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other legislation that cannot be excluded or limited by contract.
2. The service
open for offer provides an online property marketplace connecting buyers and sellers of residential property in the United Kingdom. The Platform provides the following services:
- Marketplace (free): Sellers can test market interest in their property by creating a listing. Buyers can browse listings and express interest.
- DIY listing subscriptions: Paid monthly subscription plans providing enhanced listing features, visibility, and buyer verification tools.
- AI-powered valuations: Automated property estimates generated from publicly available data. These are informational estimates only and are not RICS-accredited valuations (see section 8).
- Buyer–seller communication: Secure messaging between verified users on the Platform.
We are a technology platform. For the avoidance of doubt, the marketplace and DIY listing services do not constitute estate agency work within the meaning of the Estate Agents Act 1979. We do not negotiate on behalf of buyers or sellers, and we do not provide property advice.
3. Mortgage introductions
open for offer may introduce you to independently FCA-regulated mortgage brokers. Our primary mortgage partner is Boon Brokers (FCA No. 973757), a directly authorised, fee-free, whole-of-market mortgage broker. open for offer acts as an introducer only and is not itself authorised or regulated by the Financial Conduct Authority for the provision of mortgage advice.
We do not provide mortgage advice. Any introduction to a mortgage broker is not a personal recommendation. You should seek independent financial advice before entering into any mortgage commitment. We may receive a commission or referral fee from the mortgage broker to whom you are introduced; details of any such fee will be disclosed to you before the introduction is made.
When you consent to a mortgage introduction, we share your contact details and financial summary with the named broker so they can provide you with a personalised quote. You can withdraw your consent at any time by emailing hello@openforoffer.com. The broker is independently regulated and any advice they provide is their responsibility, not ours.
4. Your account
You must create an account to use certain features. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate, current, and complete information and keep it up to date. We reserve the right to suspend or terminate accounts that violate these terms or where we reasonably suspect fraudulent activity.
You must be at least 18 years old and resident in the United Kingdom to create an account. By creating an account, you represent and warrant that you meet these requirements.
5. Property listings and material information
Sellers are responsible for the accuracy, completeness, and legality of all property information they provide. By creating a listing, you represent and warrant that:
- You have legal authority to sell the property or have been authorised by the legal owner to list it.
- All information provided is accurate and complete to the best of your knowledge.
- You have disclosed all material information that a reasonable buyer would need to make an informed decision, including (but not limited to) known structural issues, flooding history, disputes, restrictive covenants, rights of way, and planning applications.
- You understand that providing false or misleading property information may constitute a criminal offence under the Digital Markets, Competition and Consumers Act 2024 and the Fraud Act 2006.
We require certain information before a listing can be published, including EPC rating, council tax band, tenure, and flood risk classification. We may verify this information against public data sources. We reserve the right to remove or suspend any listing that is inaccurate, misleading, incomplete, or fraudulent.
You indemnify OMPT Group Limited against any claims, losses, damages, or liabilities arising from inaccurate or misleading information you provide in a property listing.
6. Offers and the transaction process
Offers made through the Platform are expressions of interest and are not legally binding contracts. A legally binding agreement for the sale of property is formed only when contracts are exchanged through the formal conveyancing process conducted by qualified solicitors or licensed conveyancers. Both buyers and sellers may withdraw at any time before exchange of contracts.
When submitting an offer, buyers may be asked to provide proof of funds, a mortgage agreement in principle, and details of any property chain. Where we display information about a buyer’s financial position or verification status, this is based on automated checks with inherent limitations. We do not guarantee the accuracy of buyer verification data, and sellers should conduct their own due diligence.
7. Identity verification and anti-money laundering
We are committed to preventing money laundering and fraud. We may require you to verify your identity before using certain features of the Platform. This may include providing photographic identification, proof of address, and proof of funds.
Identity verification is conducted using third-party providers. By using our verification services, you consent to the processing of your identity documents and biometric data (facial comparison) for the purpose of verification. We may also screen your details against sanctions lists and politically exposed persons databases as required by the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017.
We reserve the right to refuse access to the Platform or suspend your account if we are unable to verify your identity to our satisfaction, or if we identify suspicious activity.
8. AI valuations — important limitations
Important: AI-generated valuations are automated estimates based on publicly available data, including historic sales records, property attributes, and market trends. They are provided for informational purposes only and are not RICS-accredited valuations.
AI valuations should not be relied upon for mortgage applications, insurance purposes, tax calculations, or any financial decision. We strongly recommend obtaining a professional valuation from a RICS-registered surveyor before making significant decisions about buying, selling, or pricing a property.
AI valuations are time-stamped and should be considered valid for a maximum of 90 days from the date of generation. Market conditions change, and stale valuations may not reflect current values.
9. Fees, payments, and your right to cancel
Testing the market is free. Subscription plans and their pricing are detailed on our pricing page. All prices are shown inclusive of VAT where applicable. All payments are processed securely by Stripe. We do not store your payment card details on our servers.
Your right to cancel (cooling-off period)
If you are a consumer, you have the right to cancel your subscription within 14 days of purchase for a full refund, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, contact us at support@openforoffer.com or use the cancellation button in your account settings.
Digital content (valuation reports, intelligence packs)
For one-off digital content purchases (such as AI valuation reports or property intelligence packs), you will be asked to provide express consent to begin delivery immediately and to acknowledge that you will lose your right to cancel once the digital content has been delivered. If you do not provide this consent, the 14-day cancellation period applies.
Subscription renewal and cancellation
Subscriptions renew automatically each month. You may cancel at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. We will send you a confirmation email within 24 hours of cancellation.
We may change our pricing with 30 days’ written notice to affected subscribers. If you do not agree to the new pricing, you may cancel your subscription before the new pricing takes effect.
10. Prohibited conduct
You must not:
- Provide false, misleading, or incomplete property information
- Submit fraudulent offers or impersonate any person
- Attempt to circumvent identity verification or buyer qualification processes
- Use the Platform for money laundering, terrorist financing, or any other illegal activity
- Scrape, harvest, or use automated tools to access our data without written permission
- Harass, threaten, or abuse other users through our messaging system
- Interfere with the operation, security, or integrity of the Platform
11. Intellectual property
All content on the Platform (including but not limited to the software, design, text, graphics, logos, and AI valuation algorithms) is owned by or licensed to OMPT Group Limited and is protected by copyright, trade mark, and other intellectual property laws. Property listing content is licensed to us by the seller for the duration of the listing.
12. Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
Subject to the above, to the fullest extent permitted by law:
- We shall not be liable for any indirect, incidental, special, or consequential damages, loss of profit, loss of data, or loss of business opportunity arising from your use of the Platform.
- Our total aggregate liability to you for all claims arising under or in connection with these terms shall not exceed the greater of (a) the fees you have paid us in the 12 months preceding the claim, or (b) £100.
- We do not guarantee the accuracy, completeness, or reliability of AI-generated valuations, property data sourced from third parties, or information provided by other users.
We are not liable for any loss arising from the failure of a property transaction, including (without limitation) gazumping, gazundering, chain collapse, or a buyer’s or seller’s withdrawal before exchange of contracts.
13. Complaints and dispute resolution
If you are unhappy with our service, please follow our complaints procedure. We will acknowledge your complaint within 3 working days and aim to provide a full response within 15 working days. If we cannot resolve your complaint within 8 weeks, you may escalate it to our redress scheme.
You may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr, though we are not obliged to participate in alternative dispute resolution through this platform.
14. Changes to these terms
We may update these terms from time to time. Material changes will be notified to you by email at least 30 days before they take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the updated terms. If you do not agree to the updated terms, you should stop using the Platform and cancel any active subscription.
15. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, this does not affect your right to bring proceedings in the courts of your country of residence.
