Buyer negotiation: service terms

These terms explain how our buyer negotiation service works before you ask us to start. Asking us to negotiate on a home is a request, not an agreement. The agreement is made only when you have read our written terms, including the fee, and instructed us in writing.

1. Who we are

2. When we can start

The law requires a business that negotiates a purchase for a buyer to be registered with HM Revenue & Customs for anti-money-laundering supervision, and to belong to an approved redress scheme. We start negotiating for you only once both are in place. Until then we take your request, reply to confirm when we can start, and do nothing on the home.

If you need someone negotiating for you straight away, tell us when you ask and we'll be straight with you about whether we can help in time.

3. What we do

We look at the home, the prices that homes around it have sold for, and anything you tell us, and advise you on an offer. With your approval of each one, we put your offers to the seller's agent (or the seller), respond to their replies and keep you informed.

You decide every offer. You approve each one in writing, by button or by email, and your approval covers the stated amount and conditions only. You can withdraw an approval at any time before we send it. We never offer more than you have approved.

4. What we don't do

We don't arrange viewings, surveys, mortgages or conveyancing. We never hold your money: no deposits and no purchase funds. We don't guarantee any price or any saving.

We cover homes advertised for sale in England and Wales.

5. We act for the buyer only

We never act for the seller. We will not negotiate for you on a home whose owner has a subscription or any other agreement with open for offer. If the home you name is one of them, we tell you as soon as you ask and we don't keep your request.

If we, anyone who works for us, or anyone connected with us has a personal interest in the home or its sale, we will tell you in writing as soon as we know, and before you commit to anything.

6. How we use AI

We use software, including large language models, to analyse prices and draft our advice and messages. A person at open for offer checks every message before it is sent. We are responsible for everything sent in our name.

7. Fees

We will set out our fee in writing before you instruct us, with worked examples. You pay nothing unless you have agreed that fee in writing. The fee will never be taken from your deposit or purchase funds, and there is no charge for asking us to start.

8. Identity checks

Before we can act for you, the law requires us to check your identity and where the money for this purchase comes from. We may refuse or stop acting where the law requires it.

9. Cancelling and ending

You can cancel within 14 days of instructing us, for any reason, by emailing clients@openforoffer.com. After that you can end the agreement at any time by email, and ending it costs nothing. The written fee terms we send before you instruct us will say whether any fee could still be due if you later buy the home.

Before you instruct us, you can withdraw a request at any time by emailing the same address.

10. Your data

When you ask us to negotiate, we keep your name, email and the home you named, to reply to you and send you our terms (UK GDPR Article 6(1)(b): steps you asked for before a contract). We don't use them for marketing. If we haven't started for you within 90 days, we delete them.

Once you instruct us, the identity and source-of-funds records the law requires are kept for five years after our relationship ends, then deleted. Your other rights are in our privacy policy.

11. Our responsibility to you

We will provide the service with reasonable care and skill. We do not exclude liability for negligence causing death or personal injury, or for fraud.

12. Complaints

Email clients@openforoffer.com. We acknowledge within 3 working days and give a final response within 8 weeks. Before you instruct us, we will give you the details of the independent redress scheme you can refer a complaint to, free of charge.

13. Law

These terms are governed by the law of England and Wales.
